Bankruptcy Foreclosure: People with a large amount of debt may not be able to keep up with their mortgage payments. When this happens, they could lose their homes. Bankruptcy can help stop foreclosure, at least temporarily, and let the debtor keep the property and become current with his payments under the protection and supervision of the court. Another bankruptcy option is for the debtor to surrender the property and discharge the debt owed on the mortgage.
Tax debts: Most tax debts can't be eliminated in bankruptcy. Those that can be eliminated will have to be qualified for discharge and the debtor will have to be eligible for chapter 7 bankruptcy. Debtors can discharge tax debts in chapter 7 bankruptcy only if all of the following conditions are met:
- The taxes are income taxes.
- The debtor did not commit fraud or willful evasion.
- The debt is at least three years old.
- The debtor must have filed a tax return for the debt he wishes to discharge at least two years before filing for bankruptcy.
- The income tax debt must have been assessed by the IRS at least 240 days before filing of bankruptcy petition, or it must not have been assessed yet.
It is important to note that a chapter 13 bankruptcy does not eliminate tax debts. The debtor will still have to pay the full amount in a chapter 13 bankruptcy repayment plan. Also, tax debts which are not qualified for discharge under chapter 7 bankruptcy will still have to be paid at the end of a chapter 7 bankruptcy case.
Judgments: Creditors can collect debts using a variety of ways including attachment of bank accounts, seizing of assets and wage garnishment. The filing of a bankruptcy petition puts a halt to all such proceedings, and ensures that no further proceedings will occur without the permission of the bankruptcy court.
