| Lawsuits |
If you are being sued by creditors and collectors, filing of bankruptcy may put a stop or completely end the lawsuit. When a bankruptcy is filed, an automatic stay which prevents most creditors and collectors from continuing the lawsuit to collect debts against a debtor will take effect if a court has ordered it.
Automatic stay is much like a restraining order by the court that stops creditors and debtors from attempting to collect debt. Phone calls and visits would be halted by the creditors and collectors. It protects the debtor until the stay is lifted or they receive a discharge from their debts.
Filing for bankruptcy is used often to provide relief on many types of lawsuits. Chapter 7 and Chapter 13 Bankruptcy provides different kind of relief from debt. Chapter 7 discharges the debt you owe to your creditors which in turn takes some of your assets away as payment. This can vary from state to state while Chapter 13 is a repayment plan which gives you an opportunity to pay back all the debt you owe.
